October 2023 Tepezza Litigation Updated

In August there were 41 cases pending in the Tepezza class action MDL. As of this week there are  54 filed lawsuits. The volume of new cases will likely start to pick up considerably as we move forward.

Also in September, Magistrate Judge M. David Weisman was assigned for managing the discovery process, including the authority to modify the discovery deadline, and to oversee the settlement conference.

September 2023 Tepezza Litigation Updated

As word of the complications of Tepezza are being continually communicated through the media, the wave of lawsuits continues. As of late August, 2023,  46 lawsuits have been filed as part of the M.D.L. pending in the N. District of Illinois, Federal Court. Many more cases shall be filed in the near future and we anticipate a Scheduling Order being issued by the presiding Judge which will spell out critical timelines for discovery and the first “bellwether trials”. These early trials help both side determine the probable jury awards in these types of hearing loss and tinnitus claims and help with the process of a global settlement of all pending claims.

However, with  Amgen now acquiring Horizon Pharmaceuticals it has been rumored that these cases may in fact settle before the closing of the merger. It is in both companies best interests to remove this outstanding liability for unknown litigation costs as quickly as practicable. 

August 2023 Tepezza Litigation Updated

On July 18th the US Food and Drug Administration (FDA) has updated the warning label on Horizon Pharmaceutical’s TEPEZZA to include hearing impairment or loss. The label now includes a warning for “hearing impairment including hearing loss” as one of the “major recent changes” under the warnings and precautions of the drug. We believe this to be a very positive development in the litigation because the modified warning can be used as evidence of knowledge of the defective warning and the failure to provide appropriate warnings when Horizon first became aware of these adverse side effects of substantial hearing loss and tinnitus.

June 2023 Tepezza Update

The Judicial Panel on Multidistrict Litigation has ordered that all pending Tepezza lawsuits as well as all future lawsuits be consolidated in the U.S. District Court for the Northern District of Illinois, before the Honorable Thomas M. Dunkin’. In an Order dated June 2, 2023 Judge Durkin stated that such consolidation would substantially streamline pre trial proceedings, reduce duplicative discovery and avoid inconsistent rulings. The Motion for consolidation included 18 pending cases nationally. As of the date of this article there are approximately 35 Tepezza cases filed nationally. May 2023 Tepezza Litigation Update

A new peer reviewed study published by the Endocrine Society and authored by renowned Stanford University School of Medicine Professor,  Andrea Lora Kessler, M.D., has cast significant doubt about  the truthfulness of Horizon’s (manufacturer) representations concerning the safety profile of Tepezza. The title of the study is “Increased Risk of Hearing Impairment With New Thyroid Eye Disease Treatment”.

This new study found that as high as 65% of patients who had several Tepezza infusions suffered significant hearing loss, tinnitus, and other Otological symptoms. This new study directly contradicts Horizon’s representations that in the two clinical trials which were submitted to the F.D.A,  claiming  only 10% of patients suffered from hearing loss or tinnitus complications.

The authors of this study have no bias for or against Horizon  and have not been compensated for their study. The Endocrine Society of America includes 18,000 Endocinologists from 122 countries.

Similar studies are being conducted and all prior similar studies have shown a significantly higher risk for audiological impairment than what was disclosed by the manufacturer both before marketing the new drug and continuing to the present day.

April 2023 Tepezza Litigation Update

As of March 2023, lawyers are filing Tepezza product liability lawsuits around the country, alleging that the drug caused hearing damage and tinnitus following Tepezza infusions. Currently 11 cases are pending as more and more people become aware of this unknown side effect.

One of the most recently filed Tepezza cases is Diaz v. Horizon Therapeutics USA Inc., which was filed on in the Northern District of Illinois. The plaintiff, Norma Diaz, is a resident of California who suffered from thyroid eye disease (T.E.D.).  Following a series of Tepezza infusions between November 2021 and April 2022, the plaintiff experienced severe adverse reaction to the Tepezza infusions which caused permanent hearing loss and tinnitus.

The Complaint alleges that Horizon was fully aware of the hearing problems associated with Tepezza before introduction in the marketplace.  The Complaint asserts 4 separate causes of action, with the primary theory of liability being failure to warn. We are reviewing several more claims and potentially additional causes of action in April.

Tepezza Update February 2023

Tepezza litigation is expected to grow significantly throughout 2023 as individuals learn more about the undisclosed Tepezza hearing risks. Our law firm is currently receiving inquiries on a daily basis as the general public is becoming more familiar with the dangers associated with Tepezza infusions.
 Lawsuits are now being filed nationally by individuals who have been left with permanent hearing problems after receiving Tepezza infusions for the treatment of thyroid eye disease (T.E.D.) and Grave’s disease.
Studies and case reports have found that side effects of Tepezza exponentially increases the risk of hearing loss and Tinnitus.
Since the introduction of Tepezza infusion therapy in 2020 there are increasing reports of hearing related problems. The loss of hearing and tinnitus was known by Horizon prior to introduction of the drug, but in placing profits before safety, they failed to include an appropriate warning to allow those potentially harmed to make an informed choice.

Tepezza Update January 2023

There have been significant developments in Tepezza hearing loss litigation over the past several months. As of January 2023 approximately 10 lawsuits have been filed nationwide. These case all contain allegations that Horizon Pharmaceuticals aggressively marketed Tepezza for thyroid eye disease without disclosing the risk of permanent hearing loss or tinnitus.

Despite mounting evidence and multiple updated studies from the Endocrine Society, Horizon has neither recalled Tepezza or changed the warning label.

The size of the Tepezza litigation is anticipated to grow significantly throughout 2023 as more individuals learn of the damaged associated from permanent hearing loss and/or tinnitus after Tepezza infusions.
